What Is an EAD?

An Employment Authorization Document (EAD), also known as a work permit, allows certain non-citizens to legally work in the United States. It is not automatic — you must apply for it using the correct form and evidence.


Who Can Apply?

You may qualify if you are:

  • An asylum applicant (150 days after filing I-589)
  • In Temporary Protected Status (TPS)
  • Applying for Adjustment of Status (green card)
  • A DACA recipient
  • Awaiting certain court decisions

Step-by-Step Instructions

  1. File Form I-765
  2. Submit Required Documents
    • Proof of eligibility category (copy of I-589 receipt, TPS approval, etc.)
    • Copy of current photo ID (passport or prior EAD)
    • Passport-style photos
    • Filing fee or fee waiver (Form I-912)
  3. Mail the Application
    • Follow the mailing address instructions on the USCIS site based on category and location
  4. Receive a Decision
    • If approved, you’ll receive your EAD card by mail
    • Processing time varies by category

  • Biometrics fee (some cases): $85
  • Fee waiver: File Form I-912 if eligible

When to Renew

Start renewing 180 days before your card expires. Many categories get automatic 180-day extensions if you file on time.
